This Privacy Policy explains how EQ Community LLC, operating as EQ.app ("EQ.app," "we," "us," or "our"), collects, uses, discloses, retains, and protects personal information when people visit our website, use the EQ.app platform, interact with an EQ.app AI worker, connect a business system, or use related services (collectively, the "Service").

Please read this Policy before providing personal information or connecting a business system. If an EQ.app customer uses the Service to process information about candidates, workers, employees, clients, or other individuals, that customer is generally responsible for its instructions and legal basis, and EQ.app acts as its service provider or processor where applicable.

1 Scope and roles

This Policy applies when EQ.app determines why and how personal information is processed, including website visits, account administration, direct customer communications, and EQ.app-branded SMS services. It also describes processing performed for customers through configured AI workers and connected systems. A customer may have its own privacy notice for information it controls. Where that notice conflicts with this Policy regarding customer-controlled data, the customer's notice and agreement with EQ.app govern that processing.

2 Information we collect

2.1 Account and business information

We may collect your name, work email address, telephone number, job title, role, company, company website or professional profile, account identifiers, workspace membership, billing contact information, and other details you choose to provide.

2.2 Connected systems and credentials

When an authorized user connects email, calendars, file storage, applicant tracking systems, customer relationship management systems, payroll systems, messaging channels, or other business tools, we receive connection metadata, authorization tokens or credentials, and the data needed to carry out authorized work. Access is limited to the permissions approved by the customer or user. Connection credentials are protected and used to maintain the connection and perform authorized actions.

2.3 Customer content documents and communications

We process information supplied through the Service, including resumes, CVs, job descriptions, candidate and client records, documents, files, emails, chat messages, SMS messages, voice or call information where enabled, task instructions, notes, and outputs generated through the Service. Customer content is used to provide the Service and is not used by EQ.app to train general-purpose artificial intelligence models.

2.4 SMS messaging information

When you enroll in or use EQ.app SMS messaging, we may collect your mobile telephone number; the date, time, source, and status of your consent; START, Y, HELP, STOP, and other keyword activity; the content of messages exchanged with an assigned EQ.app AI worker; delivery, failure, and carrier information; and related customer-account or company information needed to provide the messaging service.

2.5 Usage device and technical information

We may automatically collect pages viewed, features used, actions requested or completed, timestamps, browser and device type, internet protocol address, operating system, log data, security events, and diagnostic or performance information.

2.6 Information from customers and other sources

A customer may provide information about its authorized users or people involved in its workflows. We may also receive business contact information from integrations, service providers, publicly available professional sources, and other sources permitted by law and the customer's instructions.

3 How we use information

  • Provide, operate, administer, secure, and maintain the Service.
  • Authenticate users and manage accounts, workspaces, permissions, and connected systems.
  • Enable AI workers to complete tasks and workflows authorized by customers and users.
  • Process documents, communications, and structured business information.
  • Generate reports, recommendations, specifications, summaries, and worker outputs.
  • Provide customer support and respond to questions and requests.
  • Send account, service, security, transactional, and consented messaging communications.
  • Monitor performance, detect misuse, investigate incidents, prevent fraud, and improve reliability.
  • Comply with legal obligations, enforce agreements, and protect rights, safety, and property.

3.1 SMS messaging uses

For authorized users who enroll, EQ.app uses SMS information to provide two-way customer-care and task-related conversations with an assigned EQ.app AI worker; respond to requests; provide relevant reminders and follow-ups; deliver help and opt-out instructions; maintain consent records; troubleshoot delivery; and comply with telecommunications requirements. The registered customer-care program does not authorize unsolicited candidate outreach or third-party marketing.

4 How we disclose information

We disclose information only as needed to provide, secure, support, administer, and improve the Service; follow customer instructions; complete a transaction; protect legal rights; or comply with law. Recipients may include:

  • Cloud hosting, storage, authentication, security, monitoring, and infrastructure providers.
  • Artificial intelligence, task-processing, data-enrichment, and automation providers used to perform authorized work.
  • Communication, telecommunications, messaging, voice, support, and transactional email providers.
  • Analytics, performance, payment, accounting, and professional service providers.
  • Business systems and recipients that customers direct EQ.app or an AI worker to use or contact.
  • Authorities, regulators, courts, advisers, or transaction counterparties when legally required or reasonably necessary.

Service providers are subject to contractual or legal restrictions and may use information only to provide services to EQ.app or as required by law. We do not sell personal information or share it for cross-context behavioral advertising.

4.1 Mobile and SMS information

We do not sell mobile telephone numbers, SMS consent records, or SMS message data. We do not share mobile information or SMS opt-in consent with third parties or affiliates for their own marketing or promotional purposes. We may disclose such information to telecommunications carriers and service providers solely to operate the messaging service, maintain security and compliance, or as required by law. SMS consent is specific to the applicable EQ.app messaging program and is not transferred for unrelated use.

4.2 Business transfers

If EQ.app is involved in a merger, financing, acquisition, reorganization, sale of assets, or similar transaction, information may be transferred as part of that transaction subject to appropriate confidentiality and applicable law.

5 Artificial intelligence and automated processing

EQ.app uses automated systems to carry out configured tasks and generate outputs. Processing may involve third-party model or infrastructure providers acting under service terms. Customer content is used to fulfill authorized work and is not used by EQ.app to train general-purpose models. Automated outputs may contain errors and should be reviewed before consequential decisions are made. EQ.app does not intend its workers to make final employment or other legally significant decisions without appropriate human oversight.

6 Google API Services Limited Use disclosure

EQ.app's use and transfer to any other application of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.

  • We access only Google user data needed for features the user or customer has explicitly enabled.
  • We do not use Google user data for advertising.
  • We do not transfer Google user data except as necessary to provide the Service, comply with law, or act with explicit consent.
  • We do not use Google user data to train artificial intelligence or machine learning models.
  • Humans may access Google user data only for security, abuse investigation, legal compliance, support, or with consent.

7 Legal bases for processing

Where laws such as the UK GDPR or EU GDPR apply, EQ.app processes personal information as necessary to perform a contract, take steps requested before entering a contract, pursue legitimate interests such as operating and securing the Service, comply with legal obligations, or act on consent where consent is required. When EQ.app processes customer-controlled personal information as a processor, the customer determines the relevant legal basis.

8 Data storage security and international transfers

We use appropriate technical and organizational measures, including access controls, workspace boundaries, encryption in transit, protected credential storage, role-scoped permissions, operational logging, monitoring, and security reviews. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

Information may be processed in the United States and other countries where EQ.app or its providers operate. Where required, we use appropriate contractual or legal safeguards for international transfers.

9 Data retention

We retain personal information for as long as reasonably necessary to provide the Service, maintain security and consent records, comply with law, resolve disputes, and enforce agreements. Account and workspace data is generally retained while the account is active. Following a valid deletion request or account closure, we aim to delete or de-identify applicable personal information and integration connections within 30 days, subject to backups, legal obligations, contractual requirements, and legitimate compliance records.

SMS consent and opt-out records may be retained after messaging ends for compliance and dispute-resolution purposes. Processed document data remains part of the customer workspace until the customer deletes it or requests removal, subject to the same exceptions.

10 Your choices and rights

Depending on your location and applicable law, you may have rights to access, correct, delete, restrict, object to, or receive a portable copy of personal information, and to withdraw consent where processing relies on consent. You may disconnect authorized integrations through available workspace controls. We may need to verify your identity and may direct requests concerning customer-controlled information to the relevant customer.

10.1 SMS choices

SMS participation is voluntary. Reply STOP at any time to opt out. After a STOP request, EQ.app may send one final confirmation message. Reply HELP for assistance or email hello@eq.community. Opting out of SMS does not prevent essential non-SMS service communications where otherwise permitted.

11 Cookies and analytics

We use essential cookies and similar technologies to maintain sessions, authentication, security, and core functionality. We may use privacy-conscious analytics to understand product usage and improve the Service. We do not use third-party advertising cookies for cross-context behavioral advertising.

12 Children's privacy

The Service is intended for business users and is not directed to people under 18. We do not knowingly collect personal information directly from children. If we learn that we collected such information contrary to this Policy, we will take appropriate steps to delete it.

13 Changes to this Policy

We may update this Policy from time to time. We will post the revised version at https://www.eq.app/privacy and update the "Last updated" date. When required by law, we will provide additional notice or obtain consent for material changes.
